By accessing or using Velantrix ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Service Description
Velantrix is an audio engineering platform that creates personalized NeuroTunes, structured cognitive audio sessions for focus, sleep, recovery, and performance. The Service generates unique sessions based on your preferences and goals. The audio content is generated dynamically and is intended for personal wellness purposes only.
3. User Accounts
To use the Service, you must create an account. You agree to:
- Provide accurate and complete information when creating your account
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
You must be at least 13 years old to use this Service. If you are under 18, you must have parental consent.
4. Subscription and Payments
The Service offers various subscription tiers with different session limits:
- Session allowances reset monthly; unused Engine Builds roll over to the next billing cycle
- Subscriptions are billed on a recurring monthly basis
- You may cancel your subscription at any time; access continues until the end of the billing period
- Refunds are handled on a case-by-case basis
- Additional Engine Build packs may be purchased and do not expire
All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, decompile, or extract the source code of our proprietary engine
- Share, resell, or redistribute generated audio content commercially
- Attempt to circumvent session limits or abuse the Service
- Use the Service in a way that could harm or overburden our infrastructure
- Create multiple accounts to circumvent restrictions
6. Intellectual Property
The Service, including its design, features, and proprietary technology, is owned by Velantrix and protected by intellectual property laws. Audio content generated through the Service is licensed to you for personal, non-commercial use only. You may not redistribute, sell, or publicly perform generated audio without explicit permission. The underlying models, algorithms, and techniques remain our exclusive property.
7. Health Disclaimer
Important: Velantrix is designed for general wellness purposes and is not a medical device or treatment. The audio content is not intended to diagnose, treat, cure, or prevent any disease or medical condition. If you have epilepsy, a seizure disorder, or any medical condition, consult your healthcare provider before using binaural beats or structured audio sessions. Do not use while driving or operating machinery. Results may vary between individuals.
8. Limitation of Liability
To the maximum extent permitted by law, Velantrix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses. Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. The Service is provided "as is" without warranties of any kind.
9. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the app settings, which will permanently remove all your data.
10. Data Usage Consent
By accepting these Terms, you consent to the use of your anonymized data for improving the Velantrix Engine and for inclusion in anonymized, aggregated research studies. All data used for these purposes is stripped of personally identifiable information. You may request deletion of your data at any time by deleting your account.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
